      24-638.   Contest of assessments.The collection of assessments to be levied to pay for the location,construction, maintenance, or repair of any ditch, levee, dike, orwatercourse, shall not be enjoined nor declared void; nor shall saidassessment be set aside in consequence of an error, omission, orirregularity committed or appearing in any of the proceedings provided forby this act and no injunction shall be allowed restricting the collectionof an assessment until the party complaining shall first pay to the countytreasurer the amount of his assessment, which amount so paid may berecovered from said district in an action brought for that purpose in casesaid injunction is made perpetual.
