Chapter 25.--ELECTIONS
Article 43.--RECALL OF ELECTED OFFICIALS

      25-4314.   Same; election; time; ballot form.If the secretary of state determines the petition is properly filed andif the office is not vacant, he or she shall prescribe the ballot form andshall call a special election to be held on a date not less than sixty (60),nor more than ninety (90), days after the date that notification is giventhat the petition was properly filed. If a primary or general electionis to be held not less than sixty (60), nor more than ninety (90), daysafter the date that notification is given that the petition was properlyfiled, the special election shall be held on the date of the primary orgeneral election. The ballot shall be designed with the question of whetherthe state officer shall be recalled, placed on the ballot in the followingmanner: "Shall (name of official) be recalled from the office of______________?". Provision shall be made for marking the question "Yes"or "No." Except as otherwise specifically provided by this act, laws applicableto question submitted elections shall apply to elections held under this section.
