Chapter 34.--GRAIN AND FORAGE
Article 2.--INSPECTING, SAMPLING, STORING, WEIGHING AND GRADING GRAIN; TERMINAL AND LOCAL WAREHOUSES

      34-235.   Schedule of charges; approval by secretary; changes inschedule.The owner, operator or manager of any public warehouse before beinglicensed under the laws of this state to conduct a grain warehouse shallfile with the secretary a schedule of charges to be made bysuch owner, operator or manager forstorage of grain if licensed. The secretary shall haveauthority todetermine whether such schedule of charges is reasonable and proper, but inno case shall such schedule of charges filed by a local public warehousebe less than the schedule of minimum charges orexceed the schedule of maximum charges as established by the secretary pursuantto the provisions of K.S.A. 34-125, andamendmentsthereto.

      The amount to be charged for storage of grain as listed on thewarehouseman's schedule of charges filed with the secretary ashereinaboveprovided shall include the cost of receiving, unloading, loading, insuring,handling (except extraordinary handling), storage and delivery of grain andno additional or special charge shall be made for any suchservices. Any licensee may change such licensee'sschedule of charges by sendingthe proposed new schedule to the secretary in writing andshall state thereasons therefor. It shall be unlawful for any public warehouseman toassess any charge other than those charges listed in suchwarehouseman's schedule ofcharges as filed with the secretary. Every public warehousemanshall keepposted and exposed at a conspicuous place on the premises of such publicwarehouse, which place shall be accessible to the public, a copy of suchwarehouseman's current approved schedule of charges.
