      39-713d.   Funeral and cemetery expenses; limitations.(a) The secretary, on the death of arecipient of assistance, if the estate of the deceased or otheravailable resources are insufficient to pay the decedent's funeral and burialexpenses, may pay funeral and cemetery expenses in amounts which shall notbe more than the maximumamounts fixed for such purposes by rules and regulations adopted by the secretary.

      (b)   Whenever a cemetery lot has been purchased or acquired for a recipientof assistance, either before or after death, and such cemetery lot wasnot purchased or acquired with public funds, the cost of such cemeterylot shall not be deducted from the funeral expenses authorized by thissection.
