Chapter 39.--MENTALLY ILL, INCAPACITATED AND DEPENDENT PERSONS; SOCIAL WELFARE
Article 7.--SOCIAL WELFARE

      39-745.   Transition; preservation of civil rights of action andproceedings; criminal actions not to abate.From and after January 1, 1974: (a) No suit, action, or otherproceeding, judicial or administrative, lawfully commenced, or which couldhave been commenced, by or against any existing state or county agencymentioned in this act, or by or against any officer of the state or countyin his official capacity or in relation to the discharge of his officialduties, shall abate by reason of the taking effect of reorganization underthe provisions of this act.

      (b)   No criminal action commenced or which could have been commenced bythe state or county shall abate by the taking effect of this act.
