Article 9.--ADULT CARE HOMES

      39-960.   Expenditures from moneys appropriated for purposes of act; whenauthorized; repayment.The secretary of social and rehabilitation services, upon request of a receiver,may authorize expenditures from moneys appropriated for purposes set forthin this act if incoming payments from the operation of the adult care homeare less than the cost incurred by the receiver in the performance of thereceiver's functions as receiver or for purposes of initialoperating expenses of the receivership. Any payments made by the secretaryof social and rehabilitation services pursuant to this section shall beowed by the owner or licensee and repaid to the secretary of social andrehabilitation services when the receivership is terminated pursuant toK.S.A. 39-963 and amendments thereto and until repaid shall constitute alien against all non-exempt personal and real property of the owner or licensee.
