40-295. Automobile insurance policies; discrimination on basis of ageof insured prohibited in issuance, extension or renewal.No insurance company licensed to do business in the state of Kansasshall in the issuance, extension or renewal of any policy or contract ofautomobile insurance or the acceptance of any application therefordiscriminate unfairly solely because of the age of the person to beinsured: Provided, That nothing herein shall be construed to interferewith the application of any applicable rate classification with respect tosuch policy or contract of insurance pursuant to article 11 of chapter 40of the Kansas Statutes Annotated. Any insurance company violating theprovisions of this act shall be subject to the penalties authorized byK.S.A. 40-1120.
