      40-2129.   Same; commissioner's recommendations for plan improvements tojoint committee, when.If, by July 1, 1995,operation of the Kansas uninsurable health insurance plan hasinadequate participation; or activity in the health insurance marketplacematerially impairs affordability or marketability of the plan; or thecommissioner deems other factors jeopardize the operation of the plan,the commissioner shall develop and submitto the joint committee on health care decisions for the 90'srecommendations the commissioner deems necessary to ensure thesuccessful operation of the plan.
