Chapter 40.--INSURANCE Article 22.--UNIFORM POLICY PROVISIONS

      40-2240.   Same; establishment; assistance bycommissioner.(a) Any small employer as defined in subsection(4) of K.S.A. 40-2209d, and amendments thereto, may establish a smallemployer health benefitplan for the purpose of providing a health benefit plan as described insubsection (u) of K.S.A. 40-2209d, andamendments thereto, covering suchemployers' eligible employees and such employees' family members. If anassociation ortrust is used for such purposes, the association or trust may not conditioneligibility or membership on the health status of members or employees.

      (b)   The commissioner shall provide assistance to employers desiring toorganize andmaintain any such benefit plan and may aid in the acquisition of the healthcare insurance by the small employer health benefit plan.
