      40-2242.   Same; qualification for employerparticipation.As a condition to participation as a member of any small employerhealthbenefit plan as provided in K.S.A. 40-2240 andamendments thereto,an employer shall have not contributed within the preceding two years to anyhealth insurance premium or health savings account on behalf of anemployee who is to be coveredby the employer's contribution other than a contribution by an employerto a health insurance premium or health savings account within thepreceding two years solely for thebenefit of the employer or the employer's dependents.
