Chapter 40.--INSURANCE Article 38.--REGULATION AND REGISTRATION OF ADMINISTRATORS

      40-3804.   Same; payment to administrator of premiums or charges;effect.Whenever an insurer utilizes the services of an administrator under theterms of a written contract as required in K.S.A. 40-3802,the payment to the administrator of any premiums or charges forinsurance by or on behalf of the insured shall be deemed to have beenreceived by the insurer, and the payment of return premiums or claims bythe insurer to the administrator shall not be deemed payment to theinsured or claimant until such payments are received by the insured orclaimant. Nothing herein shall limit any right of the insurer againstthe administrator resulting from its failure to make payments to theinsurer, insureds or claimants.
