40-444. Same; disapproval of policy form; notice, requirements; hearing.The commissioner may, within 30 days after the filing of anysuch form, disapprove such form if it contains a provision or provisionswhich are unjust, unfair, inequitable, misleading, deceptive or encouragemisrepresentation of such policy. If the commissioner notifies theinsurer who has filed any such form that it does not comply with theprovisions of this section or K.S.A. 40-420 and 40-421 and amendmentsthereto, it shall be unlawful thereafter for such insurer to issue suchform or use it in connection with any policy. In such notice, thecommissioner shall specify the reasons for disapproval and state that ahearing will be granted within 20 days after request in writing by theinsurer. Hearings under this section shall be conducted in accordance withthe provisions of the Kansas administrative procedure act.
