Chapter 40.--INSURANCE Article 50.--VIATICAL SETTLEMENTS

      40-5005.   Same; approval of forms.No person shall use a viatical settlement contract orprovide to a viator a disclosure statement form in this state unless filed withand approved by the commissioner. The commissioner shall disapprove a viaticalsettlement contract form or disclosure statement form if, in the commissioner'sopinion, the contract or provisions contained therein are unreasonable,contrary to the interests of the public or otherwise misleading or unfair tothe viator. At the commissioner's discretion, the commissioner may require thesubmission of advertising material to the commissioner.
