Chapter 41.--INTOXICATING LIQUORS AND BEVERAGES
Article 7.--CERTAIN PROHIBITED ACTS AND PENALTIES

      41-712.   Days and hours of sale byretailers.(a) Within any city where the days of saleatretail of alcoholic liquor in the original package havenot been expanded as provided byK.S.A. 2009 Supp.41-2911, and amendmentsthereto, or havebeen so expanded and subsequently restricted as provided byK.S.A. 2009 Supp.41-2911, andamendments thereto,and within any township wherethedays of sale at retail of alcoholic liquor in the original packagehave not been expanded as provided byK.S.A. 2007 2009 Supp 41-2911, and amendments thereto, or havebeen so expanded andsubsequentlyrestricted as provided byK.S.A. 2009 Supp.41-2911, and amendments thereto, nopersonshall sellat retail any alcoholic liquor in the original package: (1) On Sunday;(2) onMemorial Day,Independence Day, LaborDay, Thanksgiving Day or Christmas Day; or (3) before 9 a.m. or after 11 p.m.on anyday when the sale is permitted. The governingbody of anycity by ordinance may require the closing of premisesprior to 11 p.m., but suchordinance shallnot require closing prior to 8 p.m.

      (b)   Within any city where the days of sale at retail of alcoholic liquorinthe original package havebeen expanded as provided byK.S.A. 2009 Supp.41-2911, and amendments thereto,and have notbeen subsequently restrictedas provided byK.S.A. 2009 Supp.41-2911, andamendments thereto, and within any township where the days of sale atretail of alcoholic liquor in the original package have been expanded asprovided byK.S.A. 2009 Supp.41-2911, and amendments thereto, and have not beensubsequently restrictedas provided byK.S.A. 2009 Supp.41-2911, and amendments thereto, no personshall sell atretail alcoholic liquor in the original package: (1) On Sunday before 12 noonor after 8 p.m.; (2) on Easter Sunday, Thanksgiving Day or Christmas Day; or(3) before 9 a.m. or after 11 p.m. on any day when the sale is permitted.The governing body of any city by ordinance may require the closing of premisesprior to 11 p.m., but such ordinance shall not require closing prior to 8p.m.
