      49-431.   Act not applicable to extraction of coal in certain circumstances.The mined-land conservation and reclamation act shall not apply to the extractionof coal as an incidental part of federal, state or local government-financedhighway construction or other government-financed construction nor to theextraction of coal incidental to the extraction of other minerals wherecoal does not exceed 16 2/3% of the tonnage of minerals removed forpurposes of commercial use or sale.
