Article 6.--SURFACE-MINING LAND CONSERVATION AND RECLAMATION

      49-619.   Same; violation hearings, conduct; bond forfeiture proceedings;duties of attorney general.Upon receipt of the referral, the commission shall schedule ahearing on the violation by the operator within 30 days after the date ofreceipt. The commission, upon written request, shall afford the operator theright to appear before the commission at the hearing. The operator shall havethe right to counsel, and may produce witnesses and present statements,documents and other information with respect to the alleged violation. If thecommission determines that the operator is in violation of this act or of anyrule and regulation adopted by the director pursuant to this act, thecommission shall requestthe attorney general to institute bond forfeiture proceedings.
