      50-679.   Same; cause of action; priority overenhanced civil penalty.An elder or disabled person who suffers damage or injury as a result of aviolation of the Kansas consumer protection act has a cause of action torecover actual damages, punitive damages, if appropriate, and reasonableattorney fees. Restitution ordered pursuant to this section has priority over acivil penalty imposed pursuant to K.S.A. 50-677.
