55-101. Natural gas for residents of platted land outside city; layingand maintenance of pipes.Whenever any tract of land not in an incorporated city shall be laid outin lots or other subdivisions as now required by law, the owner of such landsor his or her assigns is authorized to lay, maintain and operate natural-gaspipes along and across the streets and other grounds dedicated by suchowner to public use for the purpose of furnishing natural gas for light andfuel to the residents of said land, and for such purpose is authorized tolay, maintain and operate natural-gas pipes across any public highway:Provided, That the said pipes shall be laid under the surface of saidstreets, public grounds, and highways, and that said streets, grounds andhighways shall be restored so as not to impair their usefulness: Andprovided further, That nothing herein shall be construed as granting tosuch owner or his or her assigns the exclusive right to furnish said residentswith natural gas for light and fuel.
