55-174. Penalty for failure to notify of intent to drill.(a) Any person, firm, association or corporation who fails to comply withthe requirement to give notice to the state corporation commission of intentto drill a seismic, core or exploratory hole for the purpose of exploration,discovery or production of oil or natural gas in accordancewith the provisions of K.S.A. 55-151, and amendments thereto, and who hasbeen convicted twice of violating such requirement, shall be prohibitedfrom drilling a seismic, core or exploratory hole in this state for thepurpose of exploration, discovery or production of oil or natural gas withinthe six-month period of time following the date of the second convictionof violating such requirement. Any such person, firm, association or corporationwho has been convicted more than twice of violating suchrequirement shall be prohibited from drilling a seismic, core or exploratoryhole in this state for the purpose of exploration, discovery or productionof oil or natural gas within the one-year period of time following thedate of the third or later conviction of violating such requirement.
(b) Any person, firm, association or corporation who shall violate theprovisions of this section shall be deemed guilty of a class B misdemeanor.
