Chapter 55.--OIL AND GAS Article 1.--OIL AND GAS WELLS; REGULATORY PROVISIONS

55-1,102. Filing of rates and other informationrequired; use ofinformation; disclosure.(a) Each person offering gas gathering services in this stateshall file with the commission copies of: (1) Rates paid for natural gaspurchased at the wellhead by the person offering gas gathering services;(2) all rates charged forgas gathering services offered by such person;and (3) such data related to thecharacteristics of the gas purchased or gathered by the person offering gasgathering services and suchinformation regarding the terms and duration of the contract as the commissiondetermines necessary. The commission shall adopt rules andregulations prescribing the form and times of filing of such rates,data and information.The commission shall not be required to analyze, publish or disseminate suchrates,data and information except to the extent otherwise required by law.

(b) Upon notice and an opportunity to be heard in accordance with theprovisions of the Kansas administrative procedure act, the commission mayimpose an administrative fine on any person for failure to file any rate, dataor information as required by this section and rules and regulations of thecommission. Such fine shall not exceed $10,000 for each day the rate, data orinformation remains unfiled as required or an aggregate amount of $250,000,whicheveris less.

(c) Rates, data and information filed pursuant to this section shall not beused by the commission to order a change in any rate except in a proceedingpursuant to K.S.A. 55-1,104.

(d) Rates, data and information filed pursuant to this section shall not besubject to K.S.A. 66-1220a, and amendmentsthereto.

(e) This section shall take effect and be in force on and after July 1,1997.
