      58-3405.   Same; effect; certain interests, claims and charges declarednull and void.Except as otherwise provided in K.S.A. 58-3404, a marketable recordtitle shall be held by its owner and shall be taken by any person dealingwith the land free and clear of all interests, claims or chargeswhatsoever, the existence of which depends upon any act, transaction, eventor omission that occurred prior to the effective date of the root of title.All such interest, claims or charges, however denominated, whether legal orequitable, present or future, whether such interests, claims or charges areasserted by a person sui juris or under a disability, whether suchperson is within or without the state, whether such person is natural orcorporate, or is private or governmental, are hereby declared to be nulland void.
