Article 40.--MUSEUM PROPERTY

      58-4002.   Definitions.As used in K.S.A. 58-4001 through 58-4013, unless the contextotherwise requires:

      (a)   "Claimant" means a person who files a notice of intent to preservean interest in property on loan to a museum as provided in K.S.A.58-4007.

      (b)   "Claimant's address" means the most recent address as shown on anotice of intent to preserve an interest in property on loan to a museum, ornoticeof change of address, which notice is on file with the museum.

      (c)   "Lender" means a person whose name appears on the records of themuseum as the person legally entitled to property held or owing by the museum.

      (d)   "Lender's address" means the most recent address as shown on themuseum's records pertaining to the property on loan from the lender.

      (e)   "Loan" means a deposit of property not accompanied by a transfer oftitle to the property.

      (f)   "Museum" means an institution which is located in this state andoperated by a nonprofit corporation or a public agency, primarily foreducational, scientific, historic preservation or aesthetic purposes, and which owns,borrows, cares for, exhibits, studies, archives or catalogs property.Museum includes, but is not limited to, historical societies, historicsites or landmarks, parks, monuments and libraries.

      (g)   "Property" means a tangible object, animate or inanimate, under amuseum's care which has intrinsic historic, artistic, scientific or cultural value.

      (h)   "Restricted certified mail" means certified mail which carries onits face, in a conspicuous place where it will not be obliterated, theendorsement "deliver to addressee only" and for which the post officeprovides the mailer with a return receipt showing the date of delivery, theplace of delivery and person to whom delivered.

      (i)   "Undocumented property" means property in the possession of a museumfor which the museum cannot determine by reference to the museum's recordsthe property's owner.
