Chapter 58.--PERSONAL AND REAL PROPERTY Part 6.--MISCELLANEOUS PROVISIONS Article 44.--UNIFORM REAL PROPERTY ELECTRONIC RECORDING ACT

      58-4404.   Register of deeds authorized to implementact.On and after July 1, 2007:

      (a)   In this section, "paper document" means a document that is received bythe register of deeds in a form that is not electronic.

      (b)   A register of deeds:

      (1)   Who implements any of the functions listed in this section shall doso in compliance with standards established by the electronic recordingcommission;

      (2)   may receive, index, store, archive and transmit electronicdocuments;

      (3)   may provide for access to, and for search and retrieval of,documentsand information by electronic means;

      (4)   who accepts electronic documents for recording shall continue toaccept paper documents as authorized by state law and shall place entries forboth types ofdocuments in the same index;

      (5)   may convert paper documents accepted for recording into electronicform;

      (6)   may convert into electronic form information recorded before theregister of deeds began to record electronic documents;

      (7)   may accept electronically any fee or tax that the register of deedsis authorized to collect; and

      (8)   may agree with other officials of a state or a politicalsubdivisionthereof, or of the United States, on procedures or processes to facilitate theelectronic satisfactionof prior approvals and conditions precedent to recording and the electronicpayment of fees andtaxes.
