      58a-407.   Evidence of oraltrust.Except as required byK.S.A.59-606, and amendments thereto, with respect to testamentary trusts or K.S.A.33-105, 33-106 and58-2401, and amendments thereto,a trust need not be evidenced by a trust instrument, but the creation of anoral trust and its terms maybe established only by clear and convincing evidence.
