Chapter 59.--PROBATE CODE Article 17.--PROVISIONS APPLICABLE TO ALL ESTATES

      59-1706.   Nonresident fiduciary; appointment of agentrequired.Every nonresident appointed a fiduciary in this state, beforeentering upon the duties of the trust, shall appoint in writing an agentresidingin the county where the appointment is made. By suchwriting, the nonresident fiduciary consents that theservice of any notice or process upon suchagentshall have the same force and effect as personal serviceupon the fiduciarywithin such county and state. Such writingshallstate thecorrect address of such agent and shall be filed in the district court wheresuch appointment is made. Such writing shall include written acceptance ofsuch appointment by the designated agent. Service of notice or process uponsuch agentshall have the same force and effect as personal service upon thefiduciary.
