Chapter 60.--PROCEDURE, CIVIL
Article 26.--GENERAL PROVISIONS

      60-2604.   Amercement of officers.If any clerk of the district court, sheriff, or other officer willfullyrefuses, or fails without clearly excusing cause, to discharge or perform aduty imposed upon him or her under this chapter, or fails to account promptly forany funds or property coming into his or her possession in any proceeding underthis chapter the court may, on the motion of any injured party and with notless than ten (10) days' notice, cause such officer to be amerced for thebenefit of the injured party in an amount equal to the loss sustained plusten percent (10%) and plus reasonable attorneys' fees. Such liability shallalso extend to the official bond of the officer.
