60-4501. Authority to bring certain civil actionsagainst firearms or ammunition manufacturers reserved to state; exception forbreach of contract or warranty.(a) The authority to bring civil suit and right to recoveragainst any firearms or ammunition manufacturer or federally licensed firearmsor ammunition dealer, by or on behalf of the state or any political subdivisionof the state, for damages, abatement of nuisance or injunctive relief arisingfrom or relating to the lawful design, manufacture, marketing or sale offirearms or ammunition to the public shall be reserved exclusively to thestate.
(b) Nothing in this act shall prohibit a political subdivision from bringingan action against a firearms or ammunition manufacturer or federally licensedfirearms or ammunition dealer for breach of contract, for breach of implied orexpress warranty or for damages caused to the employees or agents of suchpolitical subdivision by defects in firearms or ammunition purchased or used bysuch political subdivision.
(c) The provisions of this act shall apply to any action brought on or afterJanuary 24, 2001.
