65-163n. Same; bonds issued not state indebtedness; enforcibility ofcontracts, agreements and covenants.(a) Revenue bonds issued under this act, includingrefundingrevenue bonds authorizedhereunder, shall be special obligationsin accordancewith their terms and shall not constitute an indebtedness of the state ofKansasor the department, norshall they constitute indebtedness within the meaning of any constitutionalor statutory provision limiting the incurring of indebtedness.
(b) All contracts, agreements and covenants contained in the resolutionauthorizing the issuance of revenue bonds shall be binding in all respectsupon the department of health and environment and its officials, agents,employees and successors. Suchagreements, contracts and covenants shall be enforceable by appropriatelegal action brought pursuant to the terms of the resolution authorizingthe issuance of revenue bonds.
