65-171o. Public water supply systems; suppliers to providenotice, when; form of notice.The secretary of health and environment may require a supplier of waterto give notice to the persons served by the public water supply systemand to the secretary of health and environment whenever the public watersupply system:
(a) Is not in compliance with an applicable maximum contaminantlevel or treatment technique requirement of, or a testing procedureprescribed by, a primary drinking water standard adopted under K.S.A.65-171m, and amendments thereto; or
(b) fails to perform monitoring, testing, analyzing or sampling asrequired; or
(c) is subject to a variance or exception; or
(d) is not in compliance with the requirements prescribed by avariance or exemption; or
(e) is subject to potential lead contamination from either or both ofthe following: (1) The lead content in the construction materials of thepublic water distribution system; (2) corrosivity of the water supplysufficient to cause leaching of lead.
The secretary of health and environment shall by rule and regulationprescribe the form and manner for giving such notice.
