Chapter 65.--PUBLIC HEALTH
Article 1.--SECRETARY OF HEALTH AND ENVIRONMENT, ACTIVITIES

      65-189f.   Rules and regulations providing for granting exceptions.Also, notwithstanding the provisions of this act, the secretary ofhealth and environment shall adopt rules and regulations which shall,consistent with the purposes of this act, make provision for exceptions tobe made in platted areas approved by the board of county commissioners, andfiled prior to July 1, 1968, where it is shown that an undue hardship wouldotherwise result to the developer or owner, and where it is found that thegranting of such exceptions would not be unduly harmful to the health andwelfare of the area as a whole. When an exception is granted the ordergranting the same may contain a reasonable time limitation, may require theproperty owner involved to consent to and connect to a public water andsewer system when available.
