Chapter 65.--PUBLIC HEALTH Article 1.--SECRETARY OF HEALTH AND ENVIRONMENT, ACTIVITIES

      65-1,132.   Establishment of program for treatment of persons sufferingfrom hemophilia; state assistance, requirements for eligibility; rules and regulations.(a) Within the limits of appropriations therefor, thesecretary shall establish a program in accordance with the provisions ofthis act for the care andtreatment of persons suffering from hemophilia. This program shall assistpersons suffering from hemophilia who require continuing treatment withblood and blood derivativesto avoid extensive hospitalization and other crippling effects associatedwith this critical chronic bleeding condition, but who are unable to payfor the entire cost of such services on a continuing basis after payment ofclaims from private third-party payors,medicare, medicaid and other government assistance programs.

      (b)   State assistance pursuant to subsection (a) of this section shall beavailable to an applicant only after it has been shown that the applicanthas exhausted all benefits from private third-party payors, medicare, medicaid andother government assistance programs and after consideration of theindividual's income and assets. The secretary shall establish by rules andregulations standards for determining eligibility for state assistance under this act.
