Chapter 65.--PUBLIC HEALTH
Article 1.--SECRETARY OF HEALTH AND ENVIRONMENT, ACTIVITIES

      65-1,174.   Same; immunity from civil or criminal liability for reporting;privilege under 60-427 not applicable to reports under this act; section notapplicable to unauthorized disclosure due to gross negligence or willfulmisconduct.Any health care provider, whether a person or institution, whoreports cancer information to the registry in good faith and without malice, inaccordance with the requirements of this statute, shall have immunity from anyliability, civil or criminal, which might otherwise be incurred or imposed inan action resulting from such report. Notwithstanding K.S.A. 60-427 andamendments thereto, there shall be no privilege preventing the furnishing ofsuch information or reports as required by this act by any health careprovider. Nothing in this section shall be construed to apply to theunauthorized disclosure of confidential or privileged information when suchdisclosure is due to gross negligence or willful misconduct.
