Chapter 65.--PUBLIC HEALTH Article 1.--SECRETARY OF HEALTH AND ENVIRONMENT, ACTIVITIES

      65-1,187.   Odor control plan.(a) As a condition of issuance of a permit fora swine facility, the department shall require the applicant tosubmit a plan, approved by the department, for odor control ifthe application is for:

      (1)   A permit for construction or expansion of a swinefacility that has an animal unit capacity of 1,000 or more;

      (2)   a permit for expansion of a swine facility to ananimal unit capacity of 1,000 or more; or

      (3)   renewal of a permit for a swine facility that hasan animal unit capacity of 1,000 or more.

      (b)   Each swine facility that is required to submit anodor control plan shall amend such plan whenever warranted bychanges in the facility or in other conditions affecting thefacility.

      (c)   In promulgating rules and regulations governing odorcontrol plans, the secretary shall take into considerationdifferent sizes of facilities and other relevant factors.
