Chapter 65.--PUBLIC HEALTH
Article 14.--REGULATION OF DENTISTS AND DENTAL HYGIENISTS

      65-1444.   Drugs; surgery; anaesthetics; appliances;qualifications for administering intravenous sedation and general anaesthetics;sedation permits; rules and regulations; assistant administering and monitoringnitrous oxide oroxygen, requirements; denial, revocation, suspension or limitation of sedationpermit.(a) A dentist shall have the right to prescribe drugs or medicine, performsuch surgical operations, administer analgesia, localanaesthetics and usesuch appliances as may be necessary to the proper practice of dentistry.Dentists may be authorized by the board to administersedation and generalanaesthetics subject to rules and regulations concerning qualifications of suchdentists as may be adopted by the board.The boardshall have authority to issue sedation permits to administer sedation andgeneral anaesthetics.The board may establish different requirements andqualifications based upon the type of sedation or general anaesthetics thedentist is authorized by the board to use. The board may also establish byrules and regulations the requirement that the authorization to administersedation and general anaesthetics be periodically renewedand the requirements that must be met to obtain such renewal. Any office of adentist who is authorized by the board to administer sedation or generalanaesthetics shall be subject to inspection by the board for purposes ofdetermining if the dentist is in compliance with the board's rules andregulations.

      (b)   A dentist may utilize an assistant not licensed by the board in theadministration and monitoring of nitrous oxide or oxygen, or both, if thatperson is certified in cardiopulmonary resuscitation and hassatisfactorilycompleted a course of instructionwhich has been approved by the board.To be approved by the board, the course ofinstruction shall include a minimum of sixhours ofinstruction at a teaching institution accredited by the American dentalassociation and include satisfactorycompletion ofcourses which offer both didactic and clinical instruction in: (A) Theory ofpain control; (B) anatomy; (C) medical history; (D) pharmacology; and (E)emergencies and complications.

      (c)   The board may deny, revoke, suspend or limit a sedation permitfor violation by the permit holder of the requirements establishedbythe board by rules and regulationsor in lieu thereof or in addition theretomay assess a fine in accordancewith K.S.A. 65-1436, and amendments thereto.
