Chapter 65.--PUBLIC HEALTH Article 16.--REGULATION OF PHARMACISTS

      65-1688.   Same; act does not create civil liabilityor duty.No person authorized to prescribe or dispensescheduled substances and drugs of concern shall be liable to any person in acivil action fordamages or other relief for injury, death or loss to person or propertyon the basis that such person authorized to prescribe or dispensescheduled substances and drugs of concern did or did not seek or obtaininformation from the prescription monitoring program prior to prescribing ordispensing scheduled substances and drug of concern to a patient. Nothing inthis act shall be construed to create a duty or otherwise require a personauthorized to prescribe or dispense scheduled substances and drug of concernto obtain information about a patient from the prescriptionmonitoring program prior to prescribing or dispensingscheduled substances and drug of concern to such patient.
