65-1924. Same; presence of trained operator required; protective eyewearand physical aids; timer; maximum exposure time and interior temperature.(a) A tanning facility shall have an operator present duringoperating hours. The operator must betrained in the correct operation of the tanning devices used at the facilitythat the operatormay inform and assist each user in the proper use of the tanning devices.
(b) Before each use of a tanning device, the operator shall provide thecustomer with protective eyewearwhich meets the standards of title 21, part 1040.20 of the code offederal regulations. The operator maynotallow a person to use a tanning device if that person does not use theprotective eyewear. The operator shall also show each customer how to usesuitable physical aids, such as handrails and markings on the floor, tomaintain proper exposure distance as recommended by the manufacturer of thetanning device.
(c) The tanning facility shall use a timer with an accuracy of at least plusor minus 10% of any selected time interval. The facility shall limit theexposure time of a user on a tanning device to the maximum exposure timerecommended by the manufacturer. The facility shall control the interiortemperature of a tanning device so that it may not exceed 100 degreesFahrenheit.
