Chapter 65.--PUBLIC HEALTH
Article 28.--HEALING ARTS

      65-2858.   Same; authority conferred by 65-2857 additional to authorityto prosecute criminally.The authority conferred by the preceding section shall be in additionto, and not in lieu of, authority to prosecute criminally any personunlawfully engaged in the practice of the healing arts. The granting andenforcing of an injunction or quo warranto to prevent the unlawful practiceof the healing arts is a preventive measure, not a punitive measure, andthe fact that a person has been charged with or convicted of criminallyhaving so practiced shall not prevent the issuance of a writ of injunctionor quo warranto to prevent his further practice; nor shall the fact that awrit of injunction or quo warranto has been granted to prevent furtherpractice preclude the institution of criminal prosecution and punishment.
