65-3223. Who may make anatomical gift before donor'sdeath.Subject toK.S.A. 2009 Supp.65-3227, and amendments thereto, ananatomical gift of a donor's body or part may be madeduringthe life of the donor for the purpose of transplantation, therapy, research oreducation in themanner provided inK.S.A. 2009 Supp.65-3224, and amendments thereto, by:
(1) The donor, if the donor is an adult or if thedonor is a minor and is:
(A) Emancipated; or
(B) authorized under statelaw to apply for a driver's licenseor nondriver identification cardbecause the donor isat least 16 years of age;
(2) an agent of the donor, unless the power ofattorney for health care or other recordprohibits the agent from making an anatomical gift;
(3) a parent of the donor, if the donor is an unemancipated minor; or
(4) the donor's guardian.
