65-3417. Solid waste plans and programs;considerations; judicial review of secretary's actions.(a) In developing solid waste plans or the implementation of a solidwaste program in conformance with K.S.A. 65-3401 through 65-3415, and amendmentsthereto and rules and regulationsadopted thereunder, cities, counties or multiplesor combinations thereof shall considerdemographic and geographic differences within their area of jurisdiction inpromulgating solid waste plans and programs, and the board shall considerthe demographic and geographic variations in giving approval or denyingapproval of such plans and programs.
(b) Any action of the secretary pursuant to the provisions ofarticle 34 of chapter 65 of the Kansas Statutes Annotated, and amendmentsthereto, is subject toreview in accordance with the act for judicial review and civil enforcementof agency actions.
