Chapter 65.--PUBLIC HEALTH Article 4.--HOSPITALS AND OTHER FACILITIES

      65-411.   Definitions.As used in this act:

      (a)   "Secretary" means the secretary of health and environment.

      (b)   "The federal act" means titles VI and XVI of the United Statespublic health service act (42 U.S.C. 291 et seq.) and anyamendments thereto.

      (c)   "Medical facility" includes public health centers; psychiatrichospitals; health maintenance organizations as defined in K.S.A. 40-3202 andamendments thereto; medical care facilities as defined in K.S.A. 65-425 andamendments thereto; adult care homes, which term shall be limited to nursingfacilities and intermediate personal care homes as these termsare defined in K.S.A. 39-923 and amendments thereto; kidney diseasetreatment centers, including centers not located in a medical care facility;and other facilities as may be designated by the secretary of health, educationand welfare for the provision of health care.

      (d)   "Public health center" means a publicly owned facility for theprovision of public health services, including related facilities suchas laboratories, clinics and administrative offices operated inconnection with public health centers.

      (e)   "Nonprofit medical facility" means any medical facility ownedand operated by one or more nonprofit corporations or associations, nopart of the net earnings of which inures, or may lawfully inure, to thebenefit of any private shareholder or individual.

      (f)   "Medical facility project" means a project for the modernizationof a medical facility, the construction of a new outpatient or inpatientmedical facility or the conversion of an existing medical facility forthe provision of new health services.
