65-5a12. Application for care, treatment or assistance; financialeligibility; determinations; uniform standards; repayment.An application for the care, treatment or assistance of any child by thesecretary of health and environment under the provisions of this act maybe filed by any person with the secretary or a designated agent of thesecretary who shall determine the financial eligibility of the familyaccording to standards established by the secretary. The secretary oragent of the secretary shall also determine if the parents, guardian orchild is a resident of Kansas and if the child is a child with specialhealth care needs.
The secretary shall establish uniform standards of financial eligibilityfor treatment services under the services for children with special healthcare needs, including a uniform formula for shared expenses or forrepayment of services. All repayment shall be used in support of theservices for children with special health care needs.
