Article 70.--CHEMICAL CONTROL

      65-7014.   Seizure and forfeiture.(a) All regulated chemicals which have been or are intendedto bemanufactured,provided, sold, furnished, transferred, delivered, or possessed in violation ofthis act shall bedeemed contraband, and may be seized and summarily forfeited to the state.

      (b)   A violation of this act shall constitute conduct giving rise toforfeiture pursuant to theKansas standard asset forfeiture act K.S.A. 60-4101 et seq.and amendments thereto.When property is forfeited pursuant to a violation of theKansas chemical control act, the department shall sell all propertynot destroyed pursuant tosubsection (a)(2) of K.S.A. 60-4117 and amendments theretoat publicsale to the highest bidder for cash without appraisal. The proceeds of anysaleshall be credited to the cleanup account which is hereby created in thechemical control fund. Moneys in such account can only be expended directly orthrough contracts for the costs of drug manufacturing site clean ups.
