Chapter 72.--SCHOOLS Article 9.--SPECIAL EDUCATION

      72-970.   State institutions required to providespecial education and related services;standards and criteria; contracts authorized; correctional institutions,certain exemptions.(a) Except as otherwise provided in subsection (b), every stateinstitution shall provide special education and related servicesfor exceptional children housed and maintained in the stateinstitutionand such services shall meet standards and criteria set by thestate board and shall be subject toapproval by the state board. State institutions may contract with localschool districts and other appropriate agencies or individuals forspecial education or related services. Prior to the time anystate institution enters into a contractforspecial education or related services, the services to beprovided shall beapproved by the state board.

      (b)   In providing special education or related services to incarceratedchildren withdisabilities, a correctional institution shall be exempt from the requirementsof this act to theextent authorized by the federal law.
