      72-993.   Same; placement of child during pendency ofdue process proceedings.(a) If a parent or agency requests a hearing underK.S.A. 2009 Supp.72-992a, andamendmentsthereto, the child shall remain in the interim alternative educational settingpending the decisionof the hearing officer or until the expiration of theforty-five-school-day period described insubsection (a)(2) ofK.S.A. 2009 Supp.72-991a, and amendments thereto, whicheveroccurs first,unless the parentand the agencyagree otherwise.

      (b)   The agency shall arrange for an expedited hearing, which shall occurwithin 20 school days of the date the hearing is requested and shall result ina determination within 10 school days after the hearing. To expedite thehearing, the agency, within three school days of receiving the request for ahearing, shall request the state board to appoint a hearing officer to conductthe hearing.
