38.310 Property furnished by United States not to be disposed of. No military property furnished by the United States, through the agency of the state, to
any officer or soldier of the Kentucky National Guard shall be sold, bartered, exchanged,
pledged, loaned or given away. No person, not a soldier or duly authorized officer of the
state, who has possession of any military property so furnished, and which has been the
subject of any such barter, exchange, pledge, loan or gift, shall have any right, title or
interest therein, but the property may be seized and taken wherever found by any officer
of the state, civil or military, and shall thereupon be delivered to the adjutant general or
other officer authorized to receive it. The possession of such military property by any
person not a soldier or officer of the state shall be presumptive evidence of such a sale,
