Page 1 of 1 39A.110 Compensation for property taken for temporary use -- Notice to owner of property where title taken. If property is taken for temporary use, pursuant to the provisions of this chapter, the
Governor shall, within thirty (30) days of the taking, fix the amount of compensation to
be paid for the property. If the property is returned to the owner in a damaged condition or
is not returned to the owner, the Governor shall, within thirty (30) days after the taking,
fix the amount of compensation to be paid for the damage or failure to return. When the
Governor deems it advisable for the state to take title to property taken under this section,
the owner shall be notified in writing by certified mail, return receipt requested, and a
copy of the notice shall be filed with the Secretary of State. Effective: July 15, 1998
