63.140 Removal of peace officer for losing custody of prisoner. If any prisoner or other person lawfully in custody is taken from a peace officer and
lynched, killed, maimed or injured, it shall be prima facie evidence of neglect of duty on
the part of the peace officer. When such neglect of duty, or such lynching or injury is
made to appear to the Governor, he shall at once publish a proclamation declaring the
office of the peace officer vacant, and at the same time mail a copy of the proclamation to
the peace officer, whereupon the office shall be immediately vacated. Effective: October 1, 1942
