83A.110 Staggered terms for legislative body members.
(1) Staggered terms for city legislative body members may be established or abolished
only by popular vote under the provisions of KRS 83A.120.
(2) If staggered terms for legislative body members are adopted, the length of terms
shall be determined in the following manner: subsequent to the election of
legislative body members in that same election or in the next regular election but
prior to their taking office, it shall be determined that half of the legislative body
shall serve a term of two (2) years and half shall serve a term of one (1) year and the
determination shall be made by drawing lots. At each subsequent regular election,
elections shall be held for half the seats on the city legislative body.
(3) If staggered terms for legislative body members are abolished the length of terms
shall be established in the following manner: At the next regular election, the half
of the legislative body to be elected shall be elected for one (1) year terms.
(4) No city which changes either to or from staggered terms for legislative body
members under this section shall again change sooner than five (5) years from the
effective date of the last change.
