146.490 Custody of nature preserve. An owner of an area which is dedicated as a nature preserve may retain custody thereof,
or may designate a custodian, subject to the rules and regulations of the commission. If
the owner or custodian declines, is unable, or fails to administer and manage the nature
preserve in accordance with the articles of dedication, the commission shall undertake
such custodial functions as may be necessary for the protection, maintenance, and use of
the nature preserve until the disability is removed. Whenever feasible, and consistent
with the articles of dedication, the commission shall vest custody of a nature preserve in
the former owner, a private organization or an individual. History: Created 1976 Ky. Acts ch. 118, sec. 17.
