Page 1 of 1 148.796 Strategy to increase recreational activity on private land -- Landowner's permission required for entry on private land. (1) The Kentucky Recreational Trails Authority is charged with responsibility for developing and implementing a strategy to increase responsible and legal
recreational activity by all types of recreational users, including all-terrain vehicles
(ATV) and off-highway vehicles (OHV) on private land. The authority shall include
an informational campaign directed toward in-state and out-of-state recreational
users that addresses the implications of trespass, vandalism, and littering. (2) A person shall not enter upon the lands of private landowners in the absence of an agreement as defined in KRS 148.795, without the oral or written permission of the
landowner, tenant, or person who has the authority to grant permission. Effective: July 15, 2008
